1) General Information
1. For the business relationship between the nutritional counselor and health coach Linda Peters and the customer the following General Terms and Conditions shall apply exclusively in their version valid at the time the service is provided
2. Customers within the meaning of § 1 Para. 1 are private individuals, companies, and government institutions.
2) Subject of the Contract
1. The nutritional counselor and health coach offers professional counseling services tailored to the individual needs and goals of the customer.
3) Subject of Performance
1. The services include, but are not limited to, providing information and recommendations on nutrition and training, monitoring and evaluating the customer’s nutrition and training, and supporting the achievement of healthrelated goals.
2. The nutritional counselor and health coach may provide the services either in person or electronically, including, but not limited to, email, video call, or chat.
3. The nutritional counselor and health coach will provide the client with all necessary information and resources required to achieve their health-related goals including, but not limited to, nutrition plans, recipes, and educational materials.
4. The nutritional counselor and health coach reserves the right to change or modify their range of services at any time. Changes will be communicated to the client in writing.
4) Counseling and Appointments
1. Prior to the start of the counseling, a personal consultation talk with the customer takes place. Within the framework of this talk, the contents and goals are coordinated. During the consultation talk, the customer informs the nutritional counselor and health coach about their health and physical limitations.
2. A counseling session lasts between 45, 60, 90, and 120 minutes, depending on the service booked by the customer. Longer counseling sessions are agreed upon individually with the customer.
3. The counseling sessions take place online or in person.
4. Appointments are made exclusively by arrangement. The agreed appointment must be cancelled at least 24 hours before the agreed time. For appointments not kept, a fee amounting to 100% of the price for one counseling session will be charged.
5) Obligations of the Customer
1. The customer is obliged to inform the nutritional counselor and health coach unprompted before the start of the counseling session about any health limitations, illnesses, allergies, or intolerances. Should sudden health or well-being disorders occur, the customer is obliged to inform the counselor immediately.
6) Payment Terms
1. The counselor’s fee is based on the current price list.
2. The invoice is payable immediately without deduction.

7) Liability and notes
1. The nutritional counselor and health coach is generally not liable for damages suffered by the customer. This does not apply to liability due to a breach of a material contractual obligation and for liability for damages resulting from injury to life, body, or health, as well as for damages based on an intentional or grossly negligent breach of duty by the counselor, their legal representatives, or vicarious agents.
The coachings do not replace medical treatment.
2. Material contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely. Material contractual obligations of the trainer include, in particular, but not exclusively, the services.
3. The nutritional counselor and health coach is not liable for damages that occur due to the customer’s self-assessment. If the customer does not follow the instructions of the counselor and suffers damage as a result, the liability of the nutritional counselor is excluded.
4. The nutritional counselor and health coach maintains appropriate professional indemnity insurance.
8) Data Protection
1. The personal data of the customer will be stored by the counselor and used exclusively for the fulfillment of the subject of performance specified in § 3.
2. The details regarding data protection can be found in the counselor’s privacy policy.
9) Confidentiality
1. The nutritional counselor and health coach is obliged to maintain confidentiality regarding all information that becomes known in connection with the fulfillment of the counseling of the customer to maintain confidentiality. This also applies after the termination of the contractual relationship between the counselor and the customer.
10) Final Provisions
1. Amendments, supplements, and ancillary agreements require written form to be effective, unless otherwise specified in these GTC. The written form requirement also applies to the waiver of this form requirement.
2. Should any of the preceding provisions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a legally effective replacement provision that comes as close as possible to the economic success shall be agreed upon by mutual consent.
3. Should a provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected thereby.
